Child Name Change
Understanding
Child Name Change
Changing a child’s name can be a meaningful decision, whether due to family changes, personal preferences, or other circumstances. However, the process often requires court approval to ensure the change is in the child’s best interests.
In order to start the process of a child name change, it requires filing a petition with the Circuit Court, providing notice to the other parent, and a hearing (if the other parent doesn’t agree to the name change). While the process may appear to be simple if you look at the Court’s website or other legal self-help sites, it is worth consulting with and hiring an attorney to discuss your particular situation and ensure that the paperwork is done properly.
After the name change order has been entered by a judge, you will need to ensure that the birth certificate, Social Security record, and other important records (educational and health and insurance) are updated properly and promptly.
At SMITH | ASHCRAFT, we’re here to guide you through the legal requirements for a child name change, including preparing petitions, handling parental consent issues, and representing you in court if needed. We’ll make the process as smooth and stress-free as possible.
